Terms of Service

1. Acceptance of Terms

By accessing or using C5-DEV ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms apply to all users, including those who use our AI-powered app builder, website builder, App Store Optimizer (ASO) tools, and Flaunts.me link-in-bio service.

2. Services Provided

C5-DEV provides the following no-code services:

• App Builder: Build and publish native mobile apps including E-commerce, Food Ordering, and Booking apps. AI handles App Store submission.
• Website Builder: Generate complete responsive websites from plain English descriptions using AI.
• App Store Optimizer (ASO): Keyword tracking, rank monitoring, competitor analysis, and AI growth insights.
• Flaunts.me: Free link-in-bio page service for aggregating social media links.

3. Account Registration

To use our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Credits System

C5-DEV operates on a credit-based system. Credits are one-time purchase tokens that are consumed when using AI generation features including:

• Generating websites
• Using premium ASO features

Credits are non-refundable, non-transferable, and never expire. If the AI fails to generate content as expected and credits are deducted, you may request a refund of the consumed credits.

5. Subscriptions

C5-DEV offers subscription plans (Single, Starter, Pro) for accessing premium features, publishing apps, and ongoing platform usage. Subscriptions are billed monthly or annually based on your selected plan.

Subscription Features: Each plan includes a specific number of apps you can publish, priority support, and access to advanced builder features.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. You can cancel anytime through your App Store settings (iOS) or Google Play Store settings (Android).

Refunds for Subscriptions: Subscription purchases made through Apple App Store or Google Play Store are subject to their respective refund policies, not C5-DEV's. Please contact Apple or Google directly for subscription refund requests.

6. Payments, Refunds, and Credits

All payments are processed through third-party payment processors including Stripe, Apple App Store, and Google Play Store.

Refund Policy for Credits: If the AI fails to generate content as expected and credits are deducted, you may request a refund of the consumed credits. A screenshot showing the AI's failure to generate must be provided as proof. Refunds will be issued as credits to your account, not monetary refunds.

Refund Policy for Subscriptions: Subscription payments are non-refundable. However, you may cancel your subscription at any time, and the cancellation will apply to the next billing cycle.

Pricing Changes: We reserve the right to change pricing for credits and subscriptions at any time. Price changes will be communicated via email or dashboard notification.

7. App Store Submission

C5-DEV's AI handles the App Store submission process. By using this feature, you acknowledge and agree:

• You are responsible for ensuring your app products & services complies with Apple's App Store Review Guidelines
• You will receive a TestFlight invitation within 24 hours of submission for testing
• Final approval and launch on the App Store is solely at Apple's discretion
• Apple may take up to 3 days or longer to review and approve your app
• C5-DEV is not liable for rejection, delays, or removal of your app by Apple
• A valid subscription is required to publish and maintain apps on the App Store

8. Intellectual Property Rights

Your Content: All code, designs, branding, app content, website content, and intellectual property created using C5-DEV belongs to you. We claim no ownership over your creations.

Our Platform: The C5-DEV platform, AI models, templates, and underlying technology are our proprietary property. You may not copy, modify, reverse engineer, or redistribute our platform without written permission.

Management Dashboard: After publishing, you receive a management URL and dashboard optimized for iPad to manage your app, products, orders, and services.

9. User Content and Conduct

You agree not to use our Services to:

• Create apps or websites that violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, spam, or harmful content
• Impersonate any person or entity
• Attempt to hack, bypass, or disrupt our Services

10. Third-Party Services

We integrate with third-party services including Stripe (payment processing), Supabase (database), Google, Apple (App Store), Apple Game Center (Snake Game integration in Food Ordering apps), and Google Play Store. Your use of these services is subject to their respective terms and policies. We are not responsible for the actions or policies of third parties.

11. No Warranty

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or that AI generation will always produce perfect results. We strive for accuracy but AI outputs may contain errors.

12. Limitation of Liability

To the maximum extent permitted by law, C5-DEV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or app store approvals, resulting from your use of or inability to use our Services. Our total liability shall not exceed the amount paid by you to us in the six months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless C5-DEV, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights including intellectual property rights.

14. Termination

We may terminate or suspend your account immediately without notice for conduct that violates these Terms, harms our platform, or is unlawful. Upon termination, your right to use our Services ceases. Credits are non-refundable upon termination for cause. Active subscriptions will be canceled effective immediately.

15. Free Services (Flaunts.me)

Flaunts.me is provided free of charge with no subscription required. We reserve the right to modify or discontinue this free service at any time. We are not responsible for downtime or data loss on free services.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through your dashboard. Continued use of our Services after changes constitutes acceptance of the modified Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where C5-DEV is established, without regard to conflict of law principles.
